This Privacy Statement describes the personal data we collect and/or process (which may include collecting, organizing, structuring, storing, using, or disclosing) to provide products and services offered directly by Wind4Tune, Inc., including Wind4Tune’s team-building activities, business simulations, and automated corporate gift giving solutions.

What Personal Data Do We Receive?

In connection with your use of the Site and Services, we may receive various types of information related to you, as well as information you provide us about others. Sometimes you provide us with this data and sometimes data about you is collected automatically. To the extent data is associated with an identified or identifiable natural person and is protected as personal information (or substantially equivalent terms) under applicable data protection laws, it is referred to in this Privacy Policy as “Personal Data.” You acknowledge and agree we may collect, process, store, access, and disclose Personal Data disclosed by you to facilitate the provision of the Site and Services and related support for the Services in the manner described in this Privacy Policy.

  • Support: To provide customer support. And also to detect, prevent, and address technical issues in connection with our Site and Services
  • Communicate with You: We use personal data (including contact information) to communicate with you about Wind4Tune Products, features, and services, including product updates, your account, and changes to our policies and terms. We also use your information to respond to you when you contact us.
  • Marketing, Promotions and Third-Party Advertising: To send you promotional email offers or email you about updates to the Services or your use of the Services. Also, we may receive confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our services. We may also use cookies or similar technology, including from third-party advertising partners, to show you ads within Wind4Tune Products about products, services, or causes from third parties.
How Do We Share Personal Data?

Wind4Tune provides personal data to third parties only with consent or in one of the following circumstances (subject to your prior consent where required under applicable law):

  • Vendors: Wind4Tune works with third-party service providers to provide, support, and improve Wind4Tune Products and technical infrastructure, and for business services such as payment processing. Wind4Tune may also work with third-party service providers to provide advertisements and business analytics regarding Wind4Tune Products. These vendors can access personal data subject to contractual and technical requirements for protecting personal data and prohibiting them from using personal data for any purpose other than to provide services to Wind4Tune or as required by law.

  • For Legal Reasons: Wind4Tune may share personal data as needed to:
1) comply with applicable law or respond to, investigate, or participate in valid legal process and proceedings, including from law enforcement or government agencies;
2) enforce or investigate potential violations of its Terms of Service or policies;
3) detect, prevent, or investigate potential fraud, abuse, or safety and security concerns, including threats to the public;

5) protect our and our customers’ rights and property; and
6) resolve disputes and enforce agreements.

  • Marketing, Advertising, and Analytics Partners: Wind4Tune uses third-party marketing, advertising, and analytics providers: to provide statistics and analysis about how people are using Wind4Tune Products and our website; to provide advertising and marketing for Wind4Tune Products, including targeted advertising based on your use of our website; and to show you third-party advertising within Wind4Tune Products. These third-party partners may receive information about your activities on Wind4Tune’s website through third-party cookies placed on Wind4Tune’s website. To opt out of our use of third-party cookies that share data with these partners, visit our cookie management tool, available Cookie Preferences. Where required by law, Wind4Tune will first obtain your consent before engaging in the marketing or advertising activities described.

  • Resellers: If an account owner licensed or purchased Wind4Tune Products from a third-party reseller of Wind4Tune Products, the reseller may be able to access personal data and content for users, including meetings, webinars, and messages hosted by the account owner.

  • Change of Control: We may share personal data with actual or prospective acquirers, their representatives and other relevant participants in, or during negotiations of, any sale, merger, acquisition, restructuring, or change in control involving all or a portion of Wind4Tune’s business or assets, including in connection with bankruptcy or similar proceedings.
Information Security

The security of your data is important to us, and we use industry standard methods for data encryption and key management to protect data transmitted over public networks and when stored on our systems. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security, as no method of transmission over the internet or method of electronic storage is 100% secure.
Privacy Rights and Choices

If you are a resident of the European Union (EU) and European Economic Area (EEA), Switzerland, or the UK, or a resident of California, please refer to the respective dedicated sections below. Otherwise, at your request, and as required by applicable law, we will:

  • Inform you of what personal data we have about you that is under our control;
  • Amend or correct such personal data or any previous privacy preferences you selected, or direct you to
  • applicable tools; and/or
  • Delete such personal data or direct you to applicable tools.
i. Your Rights under the California Online Privacy Protection Act (CalOPPA)

We do not support Do Not Track (“DNT”). DNT is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable DNT by visiting the Preferences or Settings page of your web browser.
‍In accordance with CalOPPA, we agree to the following:
  • Site users can visit our site anonymously
  • Site users will be notified of any privacy policy changes on our Privacy Policy page
  • Site users are able to change their personal information (as defined by CalOPPA) by emailing us at support@wind4tune.com

  • The right to have your information rectified if that information is incomplete or incorrect

  • The right to request that we restrict the processing of your data
  • The right to request a copy of your personal data in machine-readable and commonly-used format
  • The right to withdraw your consent at any time where we rely on your consent to process your personal information

iii. Your Rights under the California Consumer Privacy Act (CCPA)

If you are a California resident, you are afforded certain rights under the CCPA, such as the right to access what personal information (as defined by the CCPA) we collect about you, the right to ask us to delete your personal information, and the right to tell us not to sell your personal information.

You may ask us to provide you with what personal information we have collected up to two times in a rolling twelve month period. When you make this request, the information provided may be limited to the personal information we collected about you in the previous year.

Please note that Gather does not sell your personal information and we will not discriminate against you under any circumstances for exercising your rights in connection with the CCPA. Children’s Privacy

At Wind4Tune we take children’s privacy very seriously. While the Services are designed for businesses and individuals over the age of 18, we recognize that the Wind4Tune platform may be used by individuals who have not reached this age, especially in connection with educational institutions to create virtual spaces with events that include students under the age of 18 (each a “Child”). In such cases, the host institution is responsible for managing the Child data privacy and collecting consents as may be required by law. Wind4Tune will never intentionally use Child personal data for its own purposes or to serve advertisements. Except as otherwise set forth in this section, Wind4Tune does not knowingly collect Personal Information from Children under the age of 18. If you are under 13, you should not use or attempt to use the Services or send any information about yourself to Wind4Tune. If we discover that we have directly collected information from a Child under the age of 13, we will take the appropriate measures to promptly remove that information from our Services.

If you believe that Wind4Tune may have directly collected Personal Information about a Child under the age of 18 and wish to have us remove that Personal Information, please contact us at support@wind4tune.com to let us know. We’ll work with you to make sure that information is removed from our Site and Services, as applicable.
